CONSUMER RIGHTS – RIGHT OF WITHDRAWAL – CANCELLATION AND RETURN TERMS

 

GENERAL:

  1. If you place an order electronically via the website you are using, you are deemed to have accepted the preliminary information form and the distance sales contract presented to you.

  2. Buyers are subject to the provisions of the Law on the Protection of Consumers No. 6502 and the Regulation on Distance Contracts (OG: 27.11.2014/29188) and other applicable laws regarding the sale and delivery of the products they purchase.

  3. Shipping costs, which are product dispatch expenses, shall be paid by the buyers.

  4. Each purchased product shall be delivered to the person and/or organization at the address indicated by the buyer, provided that it does not exceed the legal period of 30 days. If the product is not delivered within this period, Buyers may terminate the contract.

  5. The purchased product must be delivered in full and in accordance with the qualities specified in the order, along with any documents such as a warranty certificate and user manual, if applicable.

  6. In the event that it becomes impossible to sell the purchased product, the seller is obliged to notify the buyer in writing within 3 days of learning of this situation. The total price must be refunded to the Buyer within 14 days.

 

IF THE PRICE OF THE PURCHASED PRODUCT IS NOT PAID:

  1. If the buyer does not pay for the purchased product or cancels the payment in bank records, the Seller's obligation to deliver the product ends.

 

PURCHASES MADE WITH UNAUTHORIZED USE OF CREDIT CARD:

  1. After the product is delivered, if it is determined that the credit card used by the buyer was used unfairly by unauthorized persons and the price of the sold product is not paid to the Seller by the relevant bank or financial institution, the Buyer is obliged to return the product subject to the contract to the SELLER within 3 days, with the shipping costs to be covered by the SELLER.

 

IF THE PRODUCT CANNOT BE DELIVERED ON TIME DUE TO UNFORESEEN REASONS:

  1. If force majeure events that the Seller could not foresee occur and the product cannot be delivered on time, the situation is notified to the Buyer. The Buyer may request the cancellation of the order, replacement of the product with a similar one, or postponement of delivery until the obstacle is removed. If the Buyer cancels the order; if the payment was made in cash, this amount is refunded to them in cash within 14 days of cancellation. If the Buyer made the payment by credit card and cancels the order, the product price is refunded to the bank again within 14 days of this cancellation, however, it is possible for the bank to transfer it to the buyer's account within 2-3 weeks.

 

BUYER'S OBLIGATION TO INSPECT THE PRODUCT:

  1. The Buyer shall inspect the goods/services subject to the contract before taking delivery; they shall not take delivery of damaged or defective goods/services from the courier company such as dented, broken, torn packaging, etc. The received goods/services shall be deemed to be undamaged and intact. The BUYER is obliged to protect the goods/services carefully after delivery. If the right of withdrawal is to be exercised, the goods/services should not be used. The invoice must also be returned with the product.

 

RIGHT OF WITHDRAWAL:

  1. The BUYER may exercise their right to withdraw from the contract by rejecting the goods without assuming any legal or criminal liability and without giving any justification, provided that they notify the SELLER via the contact information below within 14 (fourteen) days from the date of delivery of the purchased product to themselves or to the person/organization at the address indicated by them.

DURATION OF RIGHT OF WITHDRAWAL:

  1. If the product purchased is a service, this 14-day period begins from the date the contract is signed. The right of withdrawal cannot be exercised in service contracts where the performance of the service has begun with the consumer's approval before the expiry of the withdrawal period.

  2. Costs arising from the exercise of the right of withdrawal belong to the SELLER.

  3. In order to exercise the right of withdrawal, it is required that a written notification be made to the SELLER by registered mail, fax, or e-mail within the 14 (fourteen) day period and that the product has not been used within the framework of the "Products for Which the Right of Withdrawal Cannot be Exercised" provisions set forth in this contract.

 

EXERCISE OF THE RIGHT OF WITHDRAWAL: 

  1. The invoice of the product delivered to the 3rd party or the BUYER, (If the invoice of the product to be returned is corporate, it must be sent together with the return invoice issued by the institution when returning. Returns of orders whose invoices are issued on behalf of institutions will not be completed if the RETURN INVOICE is not issued.)

  2. The return form, the box of the products to be returned, the packaging, and any standard accessories, if any, must be delivered in full and undamaged.

 

RETURN CONDITIONS:

  1. The SELLER is obliged to return the total price and any documents that put the BUYER under debt to the BUYER within a maximum of 10 days from the receipt of the withdrawal notification and to take back the goods within 20 days.

  2. If there is a decrease in the value of the goods for a reason arising from the BUYER's fault or if the return becomes impossible, the BUYER is obliged to compensate for the damages of the SELLER in proportion to their fault. However, the BUYER is not responsible for changes and deteriorations that occur due to the proper use of the good or product within the period of the right of withdrawal. 

  3. In the event that the campaign limit amount organized by the SELLER is fallen below due to the exercise of the right of withdrawal, the discount amount utilized within the scope of the campaign is cancelled.

 

PRODUCTS FOR WHICH THE RIGHT OF WITHDRAWAL CANNOT BE EXERCISED:

  1. Goods prepared in line with the BUYER's requests or clearly personal needs and not suitable for return, underwear bottoms, swimsuit and bikini bottoms, make-up materials, disposable products, goods that are in danger of rapid deterioration or are likely to expire, products that are not suitable for return in terms of health and hygiene if their packaging is opened by the BUYER after delivery, products that are mixed with other products after delivery and cannot be separated by their nature, goods related to periodicals such as newspapers and magazines except those provided within the scope of a subscription contract, services performed instantly in an electronic environment or intangible goods delivered instantly to the consumer, and the return of audio or image recordings, books, digital content, software programs, data recording and data storage devices, computer consumables is not possible according to the Regulation if their packaging is opened by the BUYER. Furthermore, it is not possible to exercise the right of withdrawal for services whose performance has begun with the consumer's approval before the expiry of the right of withdrawal period according to the Regulation.

  2. Cosmetic and personal care products, underwear products, swimsuits, bikinis, books, copyable software and programs, DVDs, VCDs, CDs and cassettes, and stationery consumables (toner, cartridge, ribbon, etc.) must have their packaging unopened, untested, intact and unused to be returnable.

 

DEFAULT STATUS AND LEGAL CONSEQUENCES

  1. The BUYER accepts, declares, and undertakes that if they fall into default in the case where they perform payment transactions with a credit card, they will pay interest within the framework of the credit card agreement with the cardholder bank and will be liable to the bank. In this case, the relevant bank may resort to legal remedies; may demand the arising costs and attorney's fees from the BUYER, and under any circumstances, in case of the BUYER's default due to their debt, the BUYER accepts that they will pay for the damages and losses suffered by the SELLER due to the delayed performance of the debt.
